The Bespoke Promise

Your satisfaction with our quality is highly important to us. In addition to the Thomas Tillman Bespoke return policy, if you are not completely satisfied with the quality and fit of your new garment purchase, we will provide alterations to resolve your issue. If we cannot resolve the issue, you may receive store credit toward the purchase a replacement suit of equal or lesser value of the purchase price you paid. You must present your original receipt to receive credit. Normal wear and tear on purchases are exempt from this provision.

Introduction

Please note that by creating an account, submitting an order and/or making a purchase from Thomas Tillman Bespoke, you agree to the Terms set forth below.

These Terms and Conditions (“Terms”) shall apply to any transaction between Thomas Tillman Bespoke (“Thomas Tillman Bespoke”, “TTB”, “we”, “us” or “our”) and its customers (“customer”, “you” or “your”), whether made online (“THOMASTILLMANBESPOKE.com”) or at our studio location (“Showroom”, “TTB Stores”).

Purchasing Information

1. Payments for Thomas Tillman Bespoke merchandise can be made by cash as well by credit and debit cards. TTB uses the Square payment systems and you will be issued an e-receipt.

2. A deposit payment of a minimum of 50% of the total order value must be paid to TTB, by the Customer, at the time the order is placed.

3. All outstanding amounts due under the Sale Agreement must be paid prior to the merchandise being released. Under no circumstances will merchandise be released until the outstanding total order value has been paid.

4. Finalization of orders by TTB, including fabric purchases are complete within 24 hours of the sale Once an order is finalized, it may not be cancelled. If you wish to make changes or cancel your order, please contact our Customer Experience Team by email at services@thomastillmanbespoke.com only within 1 day of submitting your order. We cannot guarantee any order changes or cancellations requested via phone at any time, even during this stated timeframe. Please ensure to double check your fabric selection, measurements and customizations before paying for your order.

5. If you cancel your order within the 1 business day period mentioned above, we will refund your original form of payment in the next 7 business days, except payments made by debit or cash, which will be refunded via Square.

6. TTB reserves the right, in its sole discretion and at any time after receiving your order, to accept, refuse, place on hold or cancel any order you submit to us. If TTB has to cancel your order a full refund will be issued.

7. After receiving your order, TTB may contact you to request clarification, additional or missing information regarding your order or your account including measurements or customizations. It is your sole responsibility to deliver the additional information to TTB in a timely and opportune manner. TTB reserves the right, in its sole discretion, to place your order on-hold or even cancel it if the requested information is not received in a timely manner or is incomplete. Orders on-hold will be automatically cancelled 15 days after being submitted if there is missing information, and a credit will be issued according to these Terms. In the event TTB makes a change to or cancels an order, we will attempt to notify you by contacting the e-mail and/or phone number provided at the time the order was submitted. If your order is cancelled, TTB will issue a credit for future use equal to the billed amount, per these Terms.

PRICING AND PROMOTIONS

Prices at the TTB studio will be displayed and referred to in U.S. Dollars. Customers shall be responsible for any currency adjustment, conversion and/or fee charged by their financial institution or payment processor when making a payment. Local currency for TTB.com will be determined by geo-location and shipping address for your order.

TTB reserves the right to change prices for products displayed at/on the TTB Stores at any time, and to correct errors that may inadvertently occur, including pricing and promotions, even after you have submitted your order.

Promotional codes or coupons may not be combined, unless expressly stated by TTB. In the event where more than one promotional code or coupon has been used by a customer when submitting an order, whether intentionally or not, TTB, at its sole discretion, reserves the right to: i) limit the number of the promotional codes or coupons applied to the order; or ii) cancel or modify the order, per these Terms. No promotional codes, including referral program rewards or email list sign-up codes are applicable towards the purchase of clearance items, even if such items were included in the clearance section for a specific timeframe.

All promotions and discounts at TTB Stores shall be subject to these Terms as well as the promotion’s own terms and conditions. In case of conflict between these Terms and the promotion’s own terms and conditions, these Terms shall apply.

Product Availability Information

There may be information at the TTB showroom or on our website that contains errors, inaccuracies, or omissions that may relate to product descriptions, price, offers, and availability. TTB reserves the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the TTB Stores is inaccurate at any time without prior notice, even after you have submitted your order.

TTB has made and will continue to make every effort to display as accurately as possible the information and colors of our products and fabrics available at the TTB Stores. TTB cannot and does not guarantee that the correct product color or texture will be accurately displayed at your device screen.

Given supply and/or fabrication constraints, some of our products may have limited availability for purchase. TTB cannot guarantee availability of a specific product and reserves the right to remove any product from the TTB Stores or change its availability for purchase at any time, including after you submit an order. In the event TTB cannot supply a product or a specific fabric you ordered, at its sole discretion, TTB will: i) contact you to select a different fabric for your garments; or ii) cancel the order and issue a credit for future use equal to your purchase price in full. If the new fabric selected has a different price than the fabric originally selected, TTB will charge you the difference accordingly.

TTB reserves the right to determine, in its sole discretion, what products will be available at the different TTB Stores.

Monograms

All of our dress shirts may be monogrammed in 5mm block letters on the breast pocket or the left cuff for $15.00. Suit jackets and blazers may be monogrammed above the left interior pocket for $15.00. Details related to monogram styles are available on our website. Specify your choice of thread color, location, and print your up to 3-character monogram (shirt) or up 2 lines of 15 characters above the pocket on the inside left (jacket/blazer).

Shipping & Delivery

TTB will ship orders to customers at their cost and will ship the order via a recognized carrier and will notify you once your order has shipped. Delivery requires a signature and Customers shall be responsible of coordinating and accepting delivery from the carrier.

Additional shipping charges and duty/customs may apply for addresses outside of the United States and Canada, which shall be the sole responsibility of the customer, as the importer of record.

All estimated shipping dates regarding your order provided by TTB to you, shall be for reference only and may not be considered a guarantee, compromise or commitment from TTB to deliver your order to you on such date. Since the actual delivery of your order can be impacted by events beyond TTB'S control once it has been shipped, TTB cannot be held liable for late deliveries.

If you need your garments for a special event or specific date, we encourage you to submit your order with at least 90 days in advance of your event or date.

Alterations

Thomas Tillman Bespoke believes that fit is the most important aspect of a suit and we want you to receive the best made to measure and bespoke shopping experience possible. All TTB made to measure and bespoke garments are made to your unique measurements and customizations and may require adjustments that can be addressed by our completing alterations.

Alterations that may be necessary as a result of a significant fluctuation in the customer’s weight or dimensions from the time of purchase to garment delivery cannot be guaranteed. Suits, shirts and suit trousers can only be altered so much before they become ill-fitting or reach the limits of material available in the garment. This relates for both taking in and letting out of garments.

Returns

Please note that we do not offer cash refunds under any circumstances, as fabric for each of your made to measure and bespoke garments is purchased and cut based on your measurements and customizations. If a garment has a defect in its construction that cannot be resolved by alterations a store credit will be provided equal to the amount of the original purchase (excluding tax and shipping charges). Customers can expect to receive a credit for future use within 7 business days after the return has been processed by TTB.

Any and all issue related to the quality or fabrication of your garments must be brought to the attention of TTB at the time of delivery and final try in-store try on.

TTB reserves the right in its sole discretion to deny the issuance of a credit for an item that is determined to be previously worn or damaged. Garments that have been altered or adjusted in any way apart from TTB, do not qualify to be returned. You must return all items you desire to have credit received for to receive any credit given to you.

After receiving the items back, TTB will process your return and issue a credit for future use. Include your original order number as reference to ensure no delays in processing your return.

Abandoned Garments

In the event that garments and/or orders are not collected from the TTB studio within 30 days after you're initially notified via email or phone of order completion and readiness for pickup/shipping, TTB reserves the right to dispose of it/them in its sole discretion and shall not be held liable for any loss or damage that you may suffer in such an event. Our Showrooms will attempt to contact you during this 30-day timeframe via your provided contact information to avoid such scenario.

Final Provisions

The present Terms and Conditions may be modified, amended and/or substituted anytime by TTB at its sole discretion, with or without prior notice. For this reason, we encourage you to review these Terms whenever you visit the TTB Store or shop online. Your use of TTB.com, as well as any transaction made at our Showrooms, will signify your agreement to these Terms. The most recent Terms posted on TTB.com or available at any of our Showrooms will be binding on you and TTB.

You agree to hold harmless and indemnify TTB, its agents and representatives against any and all liability, damages or causes of action (however named or described with respect to or arising out of either: (i) your transactions with TTB; (ii) your use of any TTB Stores; or (iii) your breach of any representation, warranty, or other provision of these Terms.

You hereby release, waive and discharge any and all claims of damage, loss or causes of action which you or any of your representatives, heirs, next of kin or assignees may have or which may hereinafter accrue to such persons against TTB, its agents and representatives as a result of your transactions with TTB.

These Terms shall be construed in accordance with all applicable federal, provincial and municipal laws and regulations of TTB’s province or state of incorporation, respectively, and the federal laws applicable therein, without regard to any conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively by the province, state and/or federal courts of such province or state. The waiver of any provision of these Terms by TTB shall not be considered a waiver of any other provision or of TTB'S right to require strict observance of each of the terms herein. If any provision under these Terms is considered void, null or illegal for any reason by a relevant authority, such provision must be adjusted just enough to correct such nullity or illegality and shall not affect the other provisions hereof.
